Well it really depends on who you talk to as to whether hacking is a
crime or not, and what hacking is.
Hacking to me, and this definition is derived from all the years I
have sat behind the keyboard writing code.
In the strictest sense, hacking is not a crime, hacking is the
ingenious method of finding new and better ways to do things via code,
ie. the GNU project. The GNU project is a concentrated effort to hack
together a free version of UNIX and all of its support mechanisms. So
one could say that Linux is a hacker project, it uses the GPL.
Hacking could be considered slang for programming and application
development, without all of the process one usually associates with a
true S/W project.
Hacking becomes a crime when it is used maliciously to attack computer
system(s) and disrupts service, or to steal information. I use the
term "information" loosely so it encompasses a broad range of
categories.
I know this email will generate flames, along with hopefully some good
debates.
BTW I have been hacking for 20 years, and along the way, I have had
the titles of S/W Developer, S/W Engineer, Designer, Architect, and a
few others. But when push came to shove and deadlines became critical,
the stops were taken out and we reverted to hacking. Hacking has also
produced many a S/W prototype.
